  • The PoA document must be:
    • Signed by the parties abroad.
    • Attested by the Indian Consulate in their country of residence.
  • Once attested, the PoA must be sent to India for registration and notarization.

2. Filing the Divorce Petition:

  • The PoA holders can file the mutual consent divorce petition in the Family Court in Ahmedabad.

Upon filing, the court will assign a date for the First Motion.

3. First Motion:

  • On the assigned date, the PoA holders appear in court on behalf of the parties.
  • The parties abroad must sign affidavits affirming their consent to the divorce. These affidavits must be:

1. Maximum Time Limit:

  • The standard procedure under Section 13B(2) of the Hindu Marriage Act, 1955 includes a 6-month cooling-off period after the First Motion.
  • The entire process (including the cooling-off period) can take up to 18 months if additional time is requested.

2. Minimum Time Limit:

  • If the 6-month cooling-off period is waived, the divorce process can be completed in as little as 2 months, depending on court efficiency.

3. Guidelines for Waiving the Cooling-Off Period:

  • The Supreme Court allows family courts to waive the cooling-off period if:
    • The parties have lived separately for more than 18 months before filing the petition.
    • All disputes (alimony, child custody, property division) have been amicably resolved.

4. Practical Time Frame in Ahmedabad:

  • In Ahmedabad, mutual consent divorces typically take:
    • Minimum of 2 months (if the cooling-off period is waived).
    • At least 6 months if the cooling-off period is not waived.

5. Court’s Discretion:

  • The family court judge has the final say on whether to waive the cooling-off period.
  • In some cases, the process may conclude within a few days after the Second Motion if all formalities are completed.
